By accessing the msgflash platform or using our services, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services. These terms apply to all platform users, including visitors, customers, and partners.

msgflash provides an API infrastructure for sending and receiving WhatsApp messages in business applications. Our services include: — Access to a REST API for WhatsApp message automation — Management of connected WhatsApp instances — Sending message campaigns — Contact and template management — Webhooks for real-time event delivery

To use our services, you must: — Be a legal entity or individual with the legal capacity to enter into contracts — Provide accurate and up-to-date information during signup — Keep your login credentials confidential — Be responsible for all activity under your account msgflash reserves the right to refuse access to its services or terminate an account at any time in case of breach of these terms.

You agree to use the msgflash platform only for lawful purposes and in accordance with these terms. It is strictly prohibited to: — Send unsolicited messages (spam) or fraudulent content — Violate WhatsApp / Meta terms of use — Use the platform to distribute illegal, defamatory, or discriminatory content — Attempt unauthorized access to other accounts or systems — Use bots, scrapers, or other automated tools in an abusive manner — Resell or redistribute the services without prior written authorization Any violation of this policy may result in immediate suspension or termination of the account.

Applicable prices are those shown on our pricing page at the time of subscription. We reserve the right to change our pricing with 30 days' notice. Subscriptions are billed monthly or annually depending on the selected option. Payment is due in advance for each billing period. In case of non-payment, we may suspend access to the services after a 7-day grace period from the due date.

All intellectual property rights relating to the msgflash platform, including software, interfaces, trademarks, logos, and documentation, remain the exclusive property of msgflash. No license or intellectual property right is granted except the limited right to use the services in accordance with these terms.

We strive to keep our services available 24/7. However, we do not guarantee uninterrupted availability. Planned maintenance may cause temporary interruptions. We will notify users in advance whenever possible. msgflash is not responsible for service interruptions caused by events outside our control (force majeure, network outages, third-party failures).

To the fullest extent permitted by applicable law, msgflash shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities arising from the use or inability to use our services. Our total liability to you for any damage shall not exceed the amount you paid to msgflash during the 3 months preceding the event giving rise to the claim.

You may terminate your account at any time from your dashboard or by contacting support. Termination takes effect at the end of the current billing period. We reserve the right to terminate your account immediately in case of a breach of these terms, without refund. Upon termination, your data will be retained for 30 days and then permanently deleted.

We reserve the right to modify these Terms of Use at any time. Changes will be published on this page with an updated date. By continuing to use our services after changes are published, you accept the new terms. If you do not agree, you must stop using the services and terminate your account.

These Terms of Use are governed by the laws applicable in the country where msgflash is established. Any dispute relating to the interpretation or enforcement of these terms shall be submitted to the competent court of the location of our registered office.
